Supreme Court Guidelines – Human Trafficking and commercial sexual exploitation (CSE)
- Supreme Court invoked Articles 32 & 142 to lay down a binding direction constituting a Victim Protection Plan covering rescue, identification, rehabilitation, prosecution, and institutional coordination.
- Key Points –
- Consent – It is the central differentiator (trafficking vs voluntary sex work).
- Rescue under the Immoral Traffic (Prevention) Act, 1956 must target exploitation and coercion, not consensual sex work.
- Rooted protections in Article 23 (prohibition of trafficking).
- Child protection integrates Juvenile Justice Act and POCSO Act for care, rehabilitation and safeguarding against sexual offences.
- Relied on Palermo Protocol –
- 3 essential elements – The Action, The Means and The Exploitation.
- Consent becomes legally irrelevant in cases where trafficking is established through force, coercion, deception, or exploitation.
